Why Register Your Trademark?

A trademark is a distinctive sign — a word, logo, phrase, shape, or combination — that identifies your goods or services and distinguishes them from competitors. Once registered, you have the exclusive legal right to use that mark in India for 10 years (renewable indefinitely).

Without registration, you have only common law rights based on prior use — difficult and expensive to enforce. A registered trademark lets you use the ® symbol, sue infringers in court, and stop identical or deceptively similar marks at the application stage.

Types of Trademarks

  • Word mark — brand name in plain text (e.g., TATA)
  • Device/logo mark — distinctive logo or design
  • Composite mark — word + logo together
  • Sound mark — a unique sound (e.g., a jingle)
  • 3D mark — distinctive shape of a product or packaging

Trademark Classes (Nice Classification)

Trademarks are registered under specific Nice Classes — 45 international classes covering goods (1–34) and services (35–45). You must identify the correct class(es) for your business. Common examples:

  • Class 9 — Software, apps, electronic instruments
  • Class 25 — Clothing, footwear
  • Class 35 — Advertising, business management services
  • Class 42 — IT services, SaaS, cloud computing
  • Class 44 — Medical, veterinary, healthcare services
Filing in the wrong class gives you no protection in the right one — always consult a professional for class selection.

Documents Required

  • Applicant's name and address
  • Brand name / logo (JPEG, min 8×8 cm, 300 dpi)
  • Proof of business (incorporation certificate, GST, or partnership deed)
  • Power of Attorney (Form TM-48) signed by authorised person
  • Date of first use in India (if claiming prior use)
  • Aadhaar and PAN of authorised signatory

Trademark Registration Process

  1. TM Search: Search the IP India database to ensure no identical/similar mark exists in your class. This is critical — a missed conflicting mark leads to opposition.
  2. Application Filing (TM-A): File Form TM-A on the IP India portal. Fee: ₹4,500 per class for individuals/startups/MSMEs (₹9,000 for others).
  3. Acknowledgement: An application number is issued immediately. You can use the ™ symbol from this point.
  4. Examination: The Registry examines the application within 1–3 months and issues an Examination Report if there are objections.
  5. Objection Reply (if any): A written reply is filed within 30 days. A hearing may be scheduled.
  6. Publication in TM Journal: The mark is published for 4 months. Any third party can file an opposition.
  7. Registration Certificate: If unopposed, the certificate is issued — typically 12–18 months from filing.

Government Fees

Applicant TypePer Class (e-filing)
Individual / Startup / MSME₹4,500
Company / LLP / Others₹9,000

Trademark Renewal

A registered trademark is valid for 10 years from the filing date and can be renewed indefinitely for another 10 years each time by filing Form TM-R with the renewal fee.

Key Takeaways

  • Register early — trademark rights in India are based on first-to-file, not first-to-use
  • ™ symbol = applied for; ® symbol = registered only
  • File in all relevant classes if your brand covers multiple product/service categories
  • International protection requires separate filing in each country (or via Madrid Protocol)
